Immigration update: BREXIT transition period has ended

The transition period ended on 31 December 2020 and the right to work rules are changing on 1 July 2021. New employees/casuals who are EU/EEA citizens will need to show that they have Pre-Settled or Settled status, Indefinite Leave to Remain, or a UK visa (instead of just their passport) to evidence they have the RTW in the UK before starting work. Showing just a passport will then only be acceptable for British and Irish nationals. Retrospective checks will not be required for EU/EEA citizens employed prior to 1 July 2021, but casuals starting a new engagement may need to meet the new RTW rules if they have been engaged before but have then had a significant gap since their last engagement.

 

 

UPDATED - Temporary changes to Right to Work processes will now end on 30 September 2022

The Home Office announced that the temporary adjustments to right to work (RTW) checks due to COVID-19, which allow a check to be undertaken remotely, are ending. In response to feedback across many different sectors, the end date for 'adjusted' checks was delayed from 16 May 2021 to 20 June 2021, then to 31 August 2021, 5 April 2022, and now until 30 September 2022. The delay to the return to 'face to face' or online right to work checks only is welcome, as is the fact that they have removed the requirement for retrospective RTW checks to be done on adjusted checks undertaken between 30 March 2020 and 30 September 2022 (inclusive).
